It's a 1939. The engine appears to be the original with some external updates ... but, there's nothing visible that keeps it from being a 1939. Thus, 221 ci with 85 bhp.

The CORRECT answer is .... as I guessed above, GVW is not an issue unless it exceeds 5,000 lbs. The '35 1/2 ton pickup @ 2600 vehicle weight does not come close fully loaded.

My registration for my '35 PU shows 2600 for the weight and the GVW is blank. (You'd want to guess the GVW is + 1000, but they really might not need it.)
