Default is it legal?

is it legal or just bad ethics to use pictures of your parts and claim to be there parts made by them? i have seen many cases of this todd murthum

First amendment speech can be challenged by Laws such as slander, fraud, and such.

What is your goal with this question?

If you as Party X going to try to sue Party Y for using Party Z's photos to sell a product, good luck. You're going to spend more money and time than is worth your while. Ditto if you're Party Z.

Hypothetically
If, when Todd was selling parts I was to photograph and use the photos to sell his parts everything is fine. However, if Todd was to use my photograph that could be a potential copyright infraction. (between Todd and me)

If, anyone used Todd's photos (without his permission) for any commercial reason, including selling Todd's parts, it could be a potential copyright infraction (between Todd and them).


If anyone used Todd's photos, with permission, or took their own photos of Todd's product to sell their own product it could be potential misrepresentation, however if disclaimed as "illustrative" it would be fine (caveat emptor). (Between that person and their customer).


Bob Drake refused permission to us to use his catalog illustrations in our catalog even to sell his parts. His illustration, his rights, and we respect it.

Todd was owner of "Northern Classic Trucks". He made top quality sheet metal panels for Ford trucks and Cabovers. He also reproduced Ford script flatbed decks and stake sides.
