Default Emergency brake actuating lever problem

I'll try to explain my problem one more time. I'm trying to put the emergency brake actuating lever on the shaft that comes through the backing plate. As received assembled from Snyder's, the keyway for the woodruff key is at the bottom, but the slot in the actuating lever is at the top when the lever is positioned beside the service brake lever
If I put the actuating lever in the upright position, the key ends up in the space above the bolt that holds the lever onto the shaft .

What am I doing wrong?
