Default copyright of this picture

We'd like to publish this diagram in a forthcoming booklet about the Model A. Does anyone know who holds the copyright?

John,
I don't know who holds the rights to the diagram but the exact same picture appears in Leslie R. Henry's book "Henry's Fabulous Model A" on page 102. It's figure 86B. This book has been around a long time, printed in 1959 by Clymer Publications. In the cover page it is stated "Printed with the permission of Ford Motor Company letter #1004." My copy is of the tenth printing, dated 1978.

It also came out in a little booklet "FORD Model A Restoration Manual, A-1". Copyright 1955 by the Ford Motor Company, Dearborn Michigan.

So with that being said...I guess the Ford Motor Company holds the "copyright".

If you don't get permission, would they put you in the "SLAMMER"??? At least, you wouldn't have to COOK or do LAUNDRY!

I think that diagram goes all the way back to the salesman's catalog that Ford published when the Model A was in the showrooms still. I have a repro of that catalog, and that diagram with dimensions is in it.

If that's the case, it probably wasn't ever copyrighted. Ford wouldn't have been interested in selling catalogs for their artistic value.

This site contains all of those old schematics and they give credit to someone called "deuceguy" (the link given to this individual doesn't work). Maybe contact this site for any advice, or likely just go ahead and use it - likely no one will care.

They can. But unless you make a habit of it, the more likely penalty is paying damages to the copyright holder and/or a fine, both of which can be substantial.

I don't think there's much doubt but that "deuceguy" never had permission to use them in the first place. In a 2005 post on the HAMB he stated:

"These are hi res scans from a book published in the 50's called "Ford MODEL A Resoration Manual"

A couple of years later he posted a picture of this book's cover and stated:

"I don't think the publisher, Polyprints, is in business anymore.'

Not much doubt that he never had any permission to use them and they've been viewed by thousands since. I wouldn't lose a minute of sleep over using anything you want.

I believe posting it in a public forum like Ford Barn qualifies as "fair use" because it is not widely distributed.

Unless you make a lot of money from a publication, it's not worth it to the Copyright holder to persecute.you. Most people or companies copyright items to make sure they receive credit for the work they create.

I don't know if this helps any but Pursuant to 17 U.S. Code § 107, certain uses of copyrighted material "for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright."

Yes so we on forums and teachers in classrooms can reuse images to teach with, write a report, people who maintain model A websites, etc.

BUT

this does not cover using in a book to make money.

"The full range of rights attach to owners of these works. The owner of copyright has the exclusive rights to do and to authorize the following:

reproduce the image
prepare new images and other works based on the original image
distribute copies of the image to the public by sale or other transfer of ownership, or by rental, lease, or lending
display the image in public."

My book is copyrighted but if you want to use anything out of it, go ahead. I'll never catch you and you'll have had the fun of reading it or looking at the pictures. I doubt anyone will find a drawing that has been available for 50 plus years. JMHO
