In my one time experience with small claims court, the other guy didn't show. The judge was like, sorry, dude, can't get blood from a stone type of ruling.
I'm not an attorney and I was young person at the time, but it all went no where and I was out the $1,000 I was owed at the end.
I wish you luck and I'd assume doing a deal out of state complicates things tremendously. I hope it all works out.
